iCapture Photography provides professional photography services, including but not limited to event photography, portrait photography, product photography, commercial photography, and other related services. By booking or using any of our services, you acknowledge and agree to the terms outlined in these Terms and Conditions.

2. Booking and Payment

  • Booking: To confirm a booking, clients must provide their contact details and a deposit or full payment as requested. Bookings are subject to availability and will be confirmed once payment is received.
  • Payment: Payment for services is due upon booking or on the day of the shoot unless otherwise agreed upon. We accept payment via credit card, debit card, or other payment methods as specified on our website. Payment for additional services or products (e.g., prints, albums) is required at the time of order.

  • Usage Rights: By engaging our services, you grant us permission to use the images and videos created for marketing, portfolio, and promotional purposes, including but not limited to posting on our website, social media platforms, or in marketing materials. If you prefer not to have your images used in this manner, you must notify us in writing prior to the session.
  • Third-Party Use: Any third-party use of the images (e.g., for publication or commercial purposes) must be discussed and agreed upon in advance. Separate licensing fees may apply for commercial use.

4. Client Responsibilities

  • Accurate Information: You agree to provide accurate and complete information when booking our services and acknowledge that failure to do so may result in delays or the inability to fulfill the booking.
  • Punctuality: It is your responsibility to ensure that you and any participants are ready and available at the agreed time for your photography session. Any delays caused by clients may result in reduced time for photography services, and additional fees may apply for extended sessions.
  • Respectful Behavior: Clients and their guests are expected to treat the photographer(s) and any other staff with respect. We reserve the right to end a session prematurely if disruptive or inappropriate behavior is encountered.

5. Delivery of Photos

  • Delivery Time: Photos and videos will typically be delivered within [insert number of days/weeks] from the date of the photoshoot, depending on the complexity of the session and editing required. Delivery may be made through digital download, email, or physical media (such as a USB drive) depending on your selected package.
  • Quality: We take great care in editing and enhancing your images, but please note that the final photos may not always match exactly what was seen on-site during the photoshoot due to differences in lighting, environment, and personal preferences.

6. Liability and Indemnity

  • Limitation of Liability: iCapture Photography will not be liable for any indirect, incidental, or consequential damages arising from the use of our services. Our liability is limited to the amount paid for the specific photography services provided.
  • Force Majeure: We are not liable for failure to perform services if the delay or failure is caused by factors outside our control, such as natural disasters, pandemics, accidents, or other circumstances beyond our reasonable control.
  • Indemnity: By using our services, you agree to indemnify and hold harmless iCapture Photography and its employees, contractors, and agents from any and all claims, damages, or losses arising from the use of our services.

7. Privacy and Data Protection

9. Governing Law
